PERLINDUNGAN HUKUM TERHADAP KORBAN KEKERASAN SEKSUAL DI LINGKUNGAN PENDIDIKAN DALAM PERSPEKTIF HUKUM ISLAM

Kasus kekerasan seksual di lingkungan pendidikan terus mengalami peningkatan dan menjadi ancaman serius terhadap terpenuhinya hak-hak peserta didik untuk memperoleh lingkungan belajar yang aman dan bermartabat. Fenomena ini tidak hanya menimbulkan dampak fisik dan psikologis bagi korban, tetapi juga menghambat proses pendidikan serta perkembangan sosial peserta didik. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap korban kekerasan seksual di lingkungan pendidikan dalam perspektif hukum Islam, serta mengkaji relevansi antara ketentuan hukum positif di Indonesia dengan prinsip-prinsip perlindungan yang diajarkan dalam Islam. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Data diperoleh melalui studi kepustakaan terhadap peraturan perundang-undangan, literatur hukum Islam, Al-Qur'an, hadis, serta jurnal ilmiah yang relevan. Hasil penelitian menunjukkan bahwa hukum Islam memberikan perlindungan yang komprehensif terhadap korban kekerasan seksual melalui prinsip hifz al-nafs (perlindungan jiwa), hifz al-'ird (perlindungan kehormatan), dan hifz al-nasl (perlindungan keturunan) sebagai bagian dari maqasid syariah. Prinsip-prinsip tersebut sejalan dengan kebijakan hukum nasional yang menekankan pencegahan, perlindungan korban, penegakan hukum, serta pemulihan hak-hak korban. Oleh karena itu, diperlukan penguatan implementasi nilai-nilai hukum Islam dalam penyusunan kebijakan dan sistem perlindungan di lingkungan pendidikan melalui pendidikan karakter, penguatan etika, serta peningkatan kesadaran seluruh pemangku kepentingan guna menciptakan lingkungan pendidikan yang aman, adil, dan bebas dari kekerasan seksual. Publication decisions
