PENERAPAN AJARAN TURUT SERTA DALAM KASUS TINDAK PIDANA KORUPSI DIKAITKANPUTUSAN NOMOR : 161/PID.B/2010/PN.BNA DENGAN TEORI PERTANGGUNGJAWABAN PIDANA
Abstrak
Implementasi penerapan ajaran turut serta dalam kasus tindak pidana korupsi tidak sesuai dengan teori pertanggungjawaban pidana dikarenakan oleh penerapannya yang tidak sesuai dan tidak memenuhi unsur keadilan, hal ini disebabkan karena terhadap para pelaku tindak pidana korupsi tidak bisa dihukum setimpal dengan apa yang telah diperbuatnya, selama ini para pelaku tindak pidana korupsi itu dijerat dengan Pasal 55 KUHP yang mengakibatkan pelaku utama tindak pidana korupsi tersebut tidak tersentuh hukum.Upaya hukum yang dapat dilakukan terhadap adanya pelaku lain yang tersangkut dalam tindak pidana korupsi yang sedang diperiksa yakni dengan melakukan penyelidikan dan penyidikan secara mendalam terhadap adanya pelaku baru yang melakukan tindak pidana korupsi tersebut. Hal ini membuktikan bahwa tindak pidana korupsi memang dilakukan secara bersama-sama, sehingga dengan penetapan tersangka-tersangka baru dapat memenuhi unsur keadilan, kemanfaatan dan kepastian hukum.Pemerintah harus segera merevisi atau menyempurnakan Undang-Undang Nomor 31 Tahun 1999 Jo Undang-Undang Nomor 20 Tahun 2001 tentang Tindak Pidana Korupsi, agar semua pelaku tindak pidana korupsi dapat tersentuh oleh hukum sehingga tidak ada perbedaan pemberlakuan terhadap para pelaku tindak pidana korupsi.Agar tetap terjaganya rasa keadilan, aparat penegak hukum harus lebih berperan aktif untuk menemukan dan menetapakan tersangka-tersangka baru baik itu pada saat proses penyelidikan dan penyidikan

Ethical Guideline for Journal Publication
The publication of an article in JLGS is an essential building block in the development of a coherent and respected network of knowledge. It is a direct reflection of the quality of the work of the authors and the institutions that support them. Peer-reviewed articles support and embody the scientific methods. It is therefore important to agree upon standards of expected ethical behavior for all parties involved in the act of publishing: the author, the editor, the reviewer, the publisher, and the society. As the publisher of JLGS takes its duties of guardianship over all stages of publishing seriously and it recognizes its ethical and other responsibilities. JLGS committed to ensuring that advertising, reprint or other commercial revenue has no impact or influence on editorial decisions.
Publication Decisions
The editors of JLGS are responsible for deciding which of the articles submitted to the journal should be published. The editors may be guided by the policies of JLGS editorial board and constrained by such legal requirements as shall then be in force regarding libel, copyright infringement and plagiarism. The editor may confer with other editors or reviewers in making publication decisions.
