PROSES PENYELESAIAN PERKARA DILUAR PENGADILAN MELALUI PENDEKATAN RESTORATIVE JUSTICE DAN ALTERNATIVE DISPUTE RESOLUTION
Abstrak
Penelitian ini tentang proses penyelesaian perkara diluar pengadilan melalui pendekatan restorative justice dan alternatif dispute resolution. Hasil penelitian menunjukkan bahwa penyelesaian perkara diluar pengadilan melalui pendekatan restorative justice digunakan untuk perkara pidana, sementara pendekatan alternatif dispute resolution lebih banyak digunakan dalam penyelesaian perkara perdata. Dalam penyelesaian perkara melalui restorative justice lebih menekankan pemulihan korban dengan memberikan pemenuhan hak-hak korban, dimana mengharuskan pelaku untuk bertanggung jawab. Sementara dalam penyelesaian perkara diluar pengadilan melalui pendekatan alternatif dispute resolution lebih kepada penyelesaian dalam hal kesepakatan bersama, dimana para pihak yang bersengketa merumuskan sendiri penyelesaian yang mereka kehendaki dengan perantara atau bantuan mediator/negosiator.

This research is about the process of resolving cases outside of court using a restorative justice approach and alternative dispute resolution. The research results show that resolving cases outside of court using a restorative justice approach is used for criminal cases, while the alternative dispute resolution approach is more widely used in resolving civil cases. In resolving cases through restorative justice, the emphasis is placed on restoring victims by providing fulfillment of victims' rights, which requires perpetrators to be held accountable. Meanwhile, resolving cases outside of court through an alternative dispute resolution approach is more about settlement in terms of mutual agreement, where the disputants formulate the resolution they want themselves through a mediator/negosiator.

Ethical Guideline for Journal Publication
The publication of an article in JLGS is an essential building block in the development of a coherent and respected network of knowledge. It is a direct reflection of the quality of the work of the authors and the institutions that support them. Peer-reviewed articles support and embody the scientific methods. It is therefore important to agree upon standards of expected ethical behavior for all parties involved in the act of publishing: the author, the editor, the reviewer, the publisher, and the society. As the publisher of JLGS takes its duties of guardianship over all stages of publishing seriously and it recognizes its ethical and other responsibilities. JLGS committed to ensuring that advertising, reprint or other commercial revenue has no impact or influence on editorial decisions.
Publication Decisions
The editors of JLGS are responsible for deciding which of the articles submitted to the journal should be published. The editors may be guided by the policies of JLGS editorial board and constrained by such legal requirements as shall then be in force regarding libel, copyright infringement and plagiarism. The editor may confer with other editors or reviewers in making publication decisions.
Fair Play
An editor at any time evaluate manuscripts for their intellectual content without regard to race, gender, sexual orientation, religious belief, ethnic origin, citizenship, or political philosophy of the authors.
Confidentiality
The editors and any editorial staff must not disclose any information about a submitted manuscript to anyone other than the corresponding author, reviewers, potential reviewers, other editorial advisers, and the publisher, as appropriate.
