PERLINDUNGAN HUKUM TERHADAP ANAK DI LUAR PERNIKAHAN YANG SAH
Abstrak
Pasal 43 ayat (1) UU Perkawinan, bahwa “anak yang dilahirkan di luar perkawinan hanya mempunyai hubungan perdata dengan ibu dan keluarga ibunya†kemudian lahirnya putusan Mahkamah Konstutusi No. 46/PUU-VIII/2010 materi pasal berubah menjadi “anak yang dilahirkan di luar perkawinan hanya mempunyai hubungan perdata dengan ibunya dan keluarga ibunya serta dengan laki-laki sebagai ayahnya yang dapat dibuktikan berdasarkan ilmu pengetahuan dan teknologi dan/atau alat bukti lain menurut hukum mempunyai hubungan darah, termasuk hubungan perdata dengan keluarga ayahnyaâ€. Ketentuan ini memberikan perbedaan perlakuan hukum terhadap anak yang lahir di luar perkawinan dan anak yang lahir dari hasil perkawinan yang sah. Hal tersebut bertentangan dengan dengan Pasal 28B ayat (2) UUD 1945, bahwa: “Setiap anak berhak atas kelangsungan hidup, tumbuh, dan berkembang serta berhak atas perlindungan dari kekerasan dan diskriminasi. Masalah pokok dalam penelitian ini yaitu bagaimanakah perlindungan hukum terhadap anak yang lahir di luar pernikahan sah. Hasil penelitian menjelaskan bahwa perlindungan anak diluar pernikahan yang sah maupunanak yang lahir tanpa nikah dapatdirealisasikan di Pengadilan Agama.Perlindungan anak di luar nikah yang perkawinan orang tuanya tidak dicatatdapat dilakukan melalui itsbat nikahdan penerapan Pasal 43 ayat (1) UU Nomor 1 Tahun 1974 pasca uji materiilMahkamah Konstitusi. Anak yang lahir tanpa perkawinan yang sah tidak dapat diberikanperlindungan melalui itsbat nikah ke Pengadilan Agama.

Ethical Guideline for Journal Publication
The publication of an article in JLGS is an essential building block in the development of a coherent and respected network of knowledge. It is a direct reflection of the quality of the work of the authors and the institutions that support them. Peer-reviewed articles support and embody the scientific methods. It is therefore important to agree upon standards of expected ethical behavior for all parties involved in the act of publishing: the author, the editor, the reviewer, the publisher, and the society. As the publisher of JLGS takes its duties of guardianship over all stages of publishing seriously and it recognizes its ethical and other responsibilities. JLGS committed to ensuring that advertising, reprint or other commercial revenue has no impact or influence on editorial decisions.
Publication Decisions
The editors of JLGS are responsible for deciding which of the articles submitted to the journal should be published. The editors may be guided by the policies of JLGS editorial board and constrained by such legal requirements as shall then be in force regarding libel, copyright infringement and plagiarism. The editor may confer with other editors or reviewers in making publication decisions.
Fair Play
An editor at any time evaluate manuscripts for their intellectual content without regard to race, gender, sexual orientation, religious belief, ethnic origin, citizenship, or political philosophy of the authors.
Confidentiality
The editors and any editorial staff must not disclose any information about a submitted manuscript to anyone other than the corresponding author, reviewers, potential reviewers, other editorial advisers, and the publisher, as appropriate.
Disclosure and conflicts of Interest
Unpublished materials disclosed in a submitted manuscript must not be used in an editor's own research without the express written consent of the author.
