ZINA DALAM PERSPEKTIF QANUN JINAYAT ACEH DAN UNDANG-UNDANG NOMOR 1 TAHUN 2023
Abstract
Hukum pidana nasional Indonesia berdasarkan Pancasila dan UUD 1945 telah diperbarui dengan Undang-Undang Nomor 1 Tahun 2023,. Hal ini mencakup ketentuan mengenai perzinahan, yang meskipun diatur, menimbulkan kekhawatiran terhadap hak asasi manusia dan privasi, Penelitian ini merupakan Penelitian Normatif. Penelitian ini keseluruhannya diambil dari kepustakaan dan kemudian dianalisis dengan menggunakan analistis-kritis,. Ada perbedaan antara undang-undang baru ini dan Qanun Jinayat di Aceh mengenai hukuman bagi pelaku perzinahan, yang menyoroti kompleksitas dan implikasi dari variasi hukum ini dalam konteks sosio-kultural di Indonesia Sebaliknya, Undang-Undang Nomor 1 Tahun 2023 di Indonesia mengatur zina dengan hukuman yang lebih ringan, menekankan perlindungan korban dibandingkan tindakan hukuman,.Hal ini mencerminkan perubahan signifikan ke arah pendekatan humanistik dalam menangani dampak hukum, dengan menyoroti konteks masyarakat di balik meningkatnya angka perceraian. Meskipun kedua kerangka hukum mengakui zina sebagai pelanggaran sosial dan moral dan memerlukan bukti substansial untuk menjatuhkan hukuman, keduanya sangat berbeda dalam pendekatan hukuman dan peran saksi dalam penuntutan. Qanun Jinayat menekankan persyaratan saksi mata yang ketat, yang seringkali mempersulit penuntutan, sementara UU Nomor 1 Tahun 2023 menawarkan standar pembuktian yang lebih fleksibel. Perbandingan tersebut menunjukkan strategi yang berbeda: penegakan Qanun Jinayat yang kaku versus fokus rehabilitatif UU No. 1, keduanya bertujuan untuk memerangi dampak buruk zina secara sosial.

Indonesia's national criminal law based on Pancasila and the 1945 Constitution has been updated with Law Number 1 of 2023,. This includes provisions regarding adultery, which, although regulated, raises concerns for human rights and privacy, is a Normative Research. This research is taken from the literature and then analyzed using critical-analysis. There are differences between this new law and the Qanun Jinayat in Aceh regarding punishment for adulterers, which highlights the complexity and implications of this variation of the law in the socio-cultural context in Indonesia In contrast, Law Number 1 of 2023 in Indonesia regulates adultery with lighter punishments, emphasizing victim protection rather than punitive measures. This reflects a significant shift towards a humanistic approach to dealing with legal repercussions, highlighting the societal context behind the rising divorce rate. Although both legal frameworks recognize zina as a social and moral offense and require substantial evidence to impose a penalty, they differ greatly in their approaches to punishment and the role of witnesses in prosecution. Qanun Jinayat emphasized strict eyewitness requirements, which often complicate prosecutions, while Law Number 1 of 2023 offers more flexible standards of proof. The comparison shows a different strategy: the rigid enforcement of Qanun Jinayat versus the rehabilitative focus of Law No. 1, both aimed at combating the ill effects of adultery socially
